Cybercrime Investigation and Evidentiary Challenges

In the digital era, the rapid growth in the use of the internet, social media, online banking, and e-commerce has led to a significant increase in cybercrimes. Cybercrimes are no longer confined to individuals alone; they also affect national security, the economic system, and the social structure of society. The investigation of cybercrimes is more complex than that of traditional crimes because it involves various issues such as digital evidence, technical expertise, international jurisdiction, and privacy concerns. This research paper analyzes the concept and types of cybercrime, the investigation process, the importance of digital evidence, and the major challenges faced during cybercrime investigations. It also examines the Indian legal framework relating to cybercrime investigation with reference to the Information Technology Act, 2000 and the Indian Evidence Act. Finally, the paper provides important suggestions and reforms for the effective control and prevention of cybercrimes.
